TERMS & CONDITIONS OF SALE
Outdoor Kitchens & Design Ltd is registered under company number 08053090. ‘The Customer’ as described herein is the person, company or organisation purchasing goods or services from Outdoor Kitchens & Design Ltd. Any order placed by ‘The Customer’ whether in person, by telephone, by mail or online (ecommerce) shall form a legally binding contract of sale, thus whilst the below terms are extensive they are given to define and protect the due rights of both ‘The Customer’ and Outdoor Kitchens & Design Ltd.
1. RETENTION OF TITLE/OWNERSHIP
1.1 Legal ownership of any goods supplied shall remain vested to Outdoor Kitchens & Design Ltd, until such time that full payment of order/invoice monies has been received from ‘The Customer’.
1.2 Should ‘The Customer’ obtain goods without making full payment, unless otherwise agreed, ‘The Customer’ accepts that Outdoor Kitchens & Design Ltd retains the right to demand and receive immediate settlement of all outstanding monies prior to transfer of ownership, or ‘The Customer’ grants Outdoor Kitchens & Design Ltd unrestricted access to reclaim the goods. The saleable condition of the goods prior to any reclaim is the sole responsibility of ‘The Customer’.
2.1 All pricing as shown upon Outdoor Kitchens & Design Ltd literature and web site are shown in (£) Pounds Sterling.
2.2 Pricing shown upon Outdoor Kitchens & Design Ltd literature and the web site are shown as either inclusive or exclusive of the current prevailing rate of Value Added Tax (VAT) and will be stated as such. Outdoor Kitchens & Design Ltd VAT number is 158 3280 01.
2.3 All pricing as shown upon any branded literature provided, i.e. manufacturer brochures, is provided for information only and does not form part of a sale.
2.4 All goods as priced, shall be supplied at a pallet or parcel delivery cost when delivered to addresses in mainland locations throughout England, Wales and Scotland.
2.5 Our ‘free delivery’ pricing only applies to orders as stated in our delivery charges and to mainland UK locations.
2.6 For orders where 2.5 applies, Outdoor Kitchens & Design Ltd shall notify ‘The Customer’ of; (a) whether their location is serviceable, and (b) any extra delivery or service charges.
2.7 Should ‘The Customer’ accept our revised service and pricing offered under 2.6 the order shall be revised and proceed. If declined, Outdoor Kitchens & Design Ltd will cancel ‘The Customers’ order and refund all order monies received.
2.8 Outdoor Kitchens & Design Ltd pricing is reviewed upon a calendar monthly basis, but revisions will be applied at any time for; (a: increases) material and manufacturer price rises, or (b: reductions) offers or promotions as defined.
2.9 Prices stated on quotations issued by Outdoor Kitchens & Design Ltd are only valid for 28 days from the date shown on the quotation.
3.1 Outdoor Kitchens & Design Ltd standard payment terms are full payment with order, unless credit terms have been agreed.
3.2 Payments are only accepted in (£) Pounds Sterling. Payments are only accepted by the following means; company cheque or banker’s cheque (made payable to ‘Outdoor Kitchens & Design Ltd’), BACS (electronic banking), Visa, MasterCard, Visa Delta and Electron. We do not accept Paypal or American Express.
3.3 When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
3.4 Unless otherwise agreed, goods shall not be released until clearance of funds into Outdoor Kitchens & Design Ltd bank account.
3.5 Where credit terms apply, having been agreed in writing by Outdoor Kitchens & Design Ltd, invoices must be paid in full by ‘The Customer’ within the agreed credit term.
3.6 Outdoor Kitchens & Design Ltd reserves the right to charge interest at a rate of two percent above the National Westminster Bank base rate from the date that the invoice is due for payment until the date on which such payments are actually received by Outdoor Kitchens & Design Ltd. In the case of any default in payment ‘The Customer’ shall give Outdoor Kitchens & Design Ltd every assistance in the repossession of the goods in respect of which payment has not been made.
3.7 Outdoor Kitchens & Design Ltd reserves the right to alter the standard payment terms of any customer if deemed appropriate, or where special terms form part of an order.
3.8 VAT is charged on all orders at the current UK rate.
4. DELIVERY AND HANDLING
4.1 Outdoor Kitchens & Design Ltd shall aim to fulfil all orders at the earliest opportunity however, any time scales stated by Outdoor Kitchens & Design Ltd will be an estimate only.
4.2 Delivery periods are provided in working days (i.e. – 20 working days = 4 weeks), to account for the incidence of public holidays and that transport couriers typically operate weekdays only.
4.3 Deliveries are made weekdays only, typically during the hours of 8.00am to 5.30pm, however this can vary depending on the delivery method. Outdoor Kitchens & Design Ltd will endeavour to give approximate delivery dates and times; however, these can only be used as an estimate and Outdoor Kitchens & Design Ltd can take no responsibility for failure of delivery during estimated times.
4.4 Most large products will arrive on a pallet due to the weight and size; Product delivery (supply only) shall be to kerbside or driveway only. It is at the discretion of the carrier or delivery driver, should they decide to transit the goods to an alternative point on the property of ‘The Customer’
4.5 As Outdoor Kitchens & Design Ltd cannot be held responsible for delay in delivery caused by; (a) the manufacturing process, or (b) third party such as a contracted carrier.
4.6 It is the responsibility of ‘The Customer’ to provide free and unobstructed access for product delivery and subsequent usage. Any failed, abortive or return delivery charges shall be recovered from ‘The Customer’ at cost.
4.7 It is the responsibility of ‘The Customer’ to notify any access concerns to Outdoor Kitchens & Design Ltd at point of order.
4.8 In the interests of Health & Safety for Outdoor Kitchens & Design Ltd employees or contractors, on delivery our bulky products shall not be; (a) lifted over walls, fences etc, and (b) transited to other floors other than highway level, nor be wheeled over gravel driveways/paths etc.
4.9 All delivered goods must be signed for (POD) by ‘The Customer’ or their appointed representative, at which point responsibility and risk of the goods (not title if unpaid) shall pass to ‘The Customer’.
4.10 If ‘The Customer’ cannot be in attendance on delivery, prior written authority and acceptance of responsibility to leave the unattended product must be sent to firstname.lastname@example.org
4.11 Goods despatched by us are treated as received unless deliveries which require a signature are refused. We are unable to process a refund for items which have been despatched until the item has come back to us. We recommend that customers returning items keep proof of postage in case any items are lost in the post. If proof of postage is not provided then we are unable to claim off the insurance and therefore we would be unable to process claims that were lost in the post.
4.12 Outdoor Kitchens & Design Ltd will not bear any abortive costs arising from ‘The Customer’ due to a failed delivery.
4.13 Should a ‘premium delivery service’ fail to occur on the expected date Outdoor Kitchens & Design Ltd shall reimburse the cost of the ‘premium delivery charge’. Reimbursement will be limited to the ‘premium delivery service’ fee paid by ‘The Customer’ at the time of ordering.
4.14 It is the duty of ‘The Customer’ to make themselves available to be contacted prior to delivery. Should Outdoor Kitchens & Design Ltd or its chosen agent is unable to contact ‘The Customer’ the delivery of the order will be adversely affected.
4.15 Outdoor Kitchens & Design Ltd is not liable for delivery delays or failures caused by factors outside of Outdoor Kitchens & Design Ltd control including “Acts of Nature”, adverse weather conditions, road accidents, vehicle breakdown or personal illness.
5.1 It is the responsibility of ‘The Customer’ to thoroughly inspect the goods at the time of delivery and only sign for the delivery if goods are delivered in good condition. Deliveries must be signed for as DAMAGED by ‘The Customer’ if necessary and only goods that are signed for as DAMAGED on a POD can be claimed for.
5.2 Shortage or damage should be reported within 24 hours with detail, either in writing to Outdoor Kitchens & Design Ltd address, by email to email@example.com or by telephone on 01285 860 088.
6.1 In accordance with your rights to a “cooling off period” under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you can cancel your order and return the goods at any time until 14 days after you receive the goods.
6.2 If you want to cancel your order you must notify Outdoor Kitchens & Design Ltd in writing (to Outdoor Kitchens & Design address or by email to firstname.lastname@example.org) before returning any items, where the items have already been despatched.
6.3 Any goods returned must be unused, un damaged, in re-saleable condition and in original unopened packaging. It is the responsibility of ‘The Customer’ to retain possession and take reasonable care of the goods, until the goods have been returned to the possession of Outdoor Kitchens & Design Ltd.
6.4 The right to return goods (or cancel an order of goods) which are not faulty does not apply to any goods which have been made to your own specifications.
6.5 Outdoor Kitchens & Design Ltd offer replacement or refund on faulty goods within their respective guarantee period. Guarantee period is 1 year unless otherwise stated.
6.6 The cost of the return of any faulty goods will be borne by Outdoor Kitchens & Design Ltd. We shall be entitled to charge you for the costs of returning goods which are not faulty.
6.6 Following notification that you wish to return the goods in return for a refund as described above, any payment taken by us in respect of the goods will be reimbursed to you within 30 days.
6.7 Due to product development, actual models may occasionally vary slightly from the details on the website, however you may return anything within 14 working days of receipt of the goods if you are not 100% satisfied. You must notify Outdoor Kitchens & Design Ltd before returning any items.
6.8 Your rights under this Returns Policy are without prejudice to any rights under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134.

Please note that ALL items and accessories on our website are designed specifically and solely for use on or in barbecues, no accessories purchased from our site should be used in a domestic oven. We accept no responsibility for any damage caused by incorrect use of an item sold on this website.
Outdoor Kitchens & Design do not disclose buyers’ information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
Data collected by this site may be used to:
a. Take and fulfill customer orders
b. Administer and enhance the site and service
c. Issue a unique identifier (e.g. customer login)
d. Monitor customer account status beyond that required for individual purchases
e. Only disclose information to third-parties for goods delivery purposes
CREDIT CARD SECURITY
Here at Outdoor Kitchens & Design we want you to feel confident and safe shopping with us online, therefore we have all our online transactions processed via Square which one of the UK’s largest online payment processing merchants.
All transaction information passed between our site and the Square Payments Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted so you can be completely secure in the knowledge that nothing our website passes to the Square Payments servers can be examined, used or modified by any third parties attempting to gain access to sensitive information. Only standard, well-reviewed cryptographic protocols and message formats (such as SSL and PGP) are used when transferring data.
Through our Payment Service Provider (Square) we are able to accept most major Credit and Debit cards including. Visa, Mastercard, Delta, Visa Electron, Solo and UK Maestro. Unfortunately at the moment we are not able to accept American Express.
